Terms and Conditions | Passporter Jersey + Gift Card Giveaway

These Terms and Conditions govern participation in the promotion "Passporter Jersey + Gift Card Giveaway"(hereinafter, the "Promotion"), organized by PASSPORTER TECHNOLOGIES, S.L. (hereinafter, "PASSPORTER"), VAT number B-98846298, with registered address at C/Carrer de Ramón Gordillo, 5, El Pla del Real, 46010 Valencia, Spain, and contact email: info@passporterapp.com.

Participation in the Promotion implies full and unconditional acceptance of these Terms and Conditions.

1. Organizer

The Promotion is organized by PASSPORTER TECHNOLOGIES, S.L.

This Promotion is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc. Participants release Instagram from any responsibility related to the Promotion.

2. Eligibility

Participation is free and voluntary.

Participants must:

Be at least eighteen (18) years old at the time of participation.
Have legal residence in a country where participation in this type of promotion is permitted.
Own a real, public, and active Instagram account.
Participate personally and under their own identity.

The following persons are excluded:

Employees of PASSPORTER.
Employees or collaborators of companies directly involved in the Promotion.
Immediate family members of the above.

PASSPORTER reserves the right to verify eligibility at any time.

3. Participation Mechanics

To participate, users must:

Follow @passporterapp on Instagram.
Comment on the official giveaway post indicating which country or team they believe will win the tournament.

Each valid comment counts as one (1) entry, provided it complies with Instagram rules and does not constitute spam.

Bonus Entry

Participants may obtain one (1) additional entry by:

Making their prediction for the tournament winner within the Passporter platform.
Sharing a screenshot of their prediction on their Instagram Stories.
Tagging @passporterapp in the Story.

Private accounts must ensure that the Story mention is visible to PASSPORTER during the verification process.

Automated participation systems, bots, fake accounts, or coordinated participation groups are strictly prohibited.

4. Promotion Period

The Promotion will begin on 3 July with the publication of the official giveaway post and will end on 11 July at 23:59 CEST.

PASSPORTER reserves the right to extend, modify, suspend, or cancel the Promotion due to force majeure, technical issues, fraud detection, or circumstances beyond its control.

5. Prize

Three (3) winners will each receive:

One (1) official Passporter jersey.

The specific experiences available through the Gift Card will be communicated to the winner upon prize acceptance and may be subject to availability.

Prize Conditions

The prize is personal and non-transferable.
The prize cannot be exchanged for cash or any other alternative.
The Gift Card shall be subject to its own redemption conditions, validity period, and booking availability.
PASSPORTER reserves the right to substitute the prize with another of equal or greater value if circumstances beyond its control make this necessary.

6. Winner Selection

One (1) winner will be selected at random among all eligible participants using a certified random selection system such as Easypromos or equivalent software.

PASSPORTER may also select substitute winners.

The bonus entry obtained through the optional Story action will count as an additional participation in the draw.

7. Winner Notification

The winner will be contacted exclusively via Instagram Direct Message from @passporterapp within seven (7) days after the Promotion ends.

The winner must respond within forty-eight (48) hours confirming acceptance of the prize.

If the winner:

Does not respond,
Rejects the prize,
Cannot be contacted, or
Fails eligibility verification,

PASSPORTER may select an alternate winner.

PASSPORTER will never request payment information via Instagram Direct Messages.

8. ManyChat Automation

Participation in the Promotion may involve the use of an automated messaging system (ManyChat) connected to Instagram.

ManyChat may:

Verify participation requirements.
Send automated confirmation messages.
Provide instructions for obtaining the bonus entry.
Redirect participants to the Passporter platform to complete their tournament prediction.

Receiving automated messages through ManyChat does not imply that the participant has won the Promotion.

9. Promotional Discount

Participants who correctly predict the tournament champion may receive, at PASSPORTER's sole discretion, an exclusive promotional discount for future travel bookings through Passporter.

This promotional discount:

Is independent of the giveaway prize.
Does not affect the winner selection process.
Will be subject to separate terms and conditions communicated at the time of delivery.

PASSPORTER reserves the right to modify or cancel this promotional incentive.

10. Limitation of Liability

PASSPORTER shall not be liable for:

Failures of Instagram, ManyChat, or internet access.
Loss of entries due to technical errors.
Interruptions affecting participation.
Technical failures preventing the correct submission of entries.

Liability shall only apply in cases of proven intentional misconduct or gross negligence as permitted by applicable law.

11. Fraud and Disqualification

PASSPORTER reserves the right to disqualify participants who:

Use fake or multiple Instagram accounts.
Manipulate the Promotion.
Use automated participation systems.
Publish offensive, illegal, or inappropriate content.
Attempt to circumvent the participation mechanics.

PASSPORTER may cancel participations suspected of fraud without prior notice.

12. Image and Promotional Rights

By accepting the prize, the winner agrees that PASSPORTER may use their name, Instagram username, and any voluntarily shared content relating to the Promotion for promotional and communication purposes without additional compensation, unless prohibited by applicable law.

13. Data Protection

Personal data collected during the Promotion will be processed exclusively for managing participation, verifying eligibility, selecting the winner, delivering the prize, and administering communications related to the Promotion.

Data processing will comply with applicable data protection regulations, including the General Data Protection Regulation (GDPR).

14. Taxes

Any taxes or fiscal obligations arising from acceptance of the prize shall be the sole responsibility of the winner where required under applicable legislation.

15. Legal Actions

Legal recourse is excluded to the extent permitted by applicable law.

16. Applicable Law and Jurisdiction

These Terms and Conditions shall be governed by Spanish law.

Any disputes arising from the Promotion shall be submitted to the courts of Valencia, Spain.

17. Availability of the Terms

These Terms and Conditions will be available through PASSPORTER's official channels and upon request.
