2. What is the purpose of the processing of your data?

The type of personal data that you provide to us and that we may process at PASSPORTER are:

  • Identification data in the application (name, email, user, password) Its purpose is to identify you in the application and to be able to be a member of PASSPORTER. The username and password is a basic security measure to prevent a third party from usurping your identity in the application. We may also ask for your permission to send you newsletters or news related to the application and the PASSPORTER community. In this case we would ask for your express consent to do so.
  • Location data provided by the user of the application: The purpose is to be able to better describe the trip you are making and the places you are visiting, so that other members of the community can get to know it or even take it as a possible route for future trips. You will be the one to tell us where you are and link to the Google Maps application to locate your location or route at the time you want.
  • Images that users decide to share with the community, either obtained directly at that moment or extracted by the user himself from the gallery of his cell phone.
  • Comments and contributions that users may post on the application and that may involve personal data due to the content they themselves provide.
  • Optionally, you may request to receive periodic information related to the PASSPORTER community via NEWSLETTER.
  • Additionally inform you that PASSPORTER may have a history of data. This treatment is necessary in order to have a history of users to allow subsequent management.

Once collected, your data is processed and the corresponding security measures are applied.

3. How long will we keep your data?

The personal data collected through the PASSPORTER APP will be kept for the time necessary to carry out the purpose of the processing for which they were provided. Once the processing has been terminated, the basic contact data may remain in a historical database of PASSPORTER, for the purpose of facilitating further processing.  Once the relationship is terminated, they will be kept blocked only for the purpose of complying with possible legal obligations.

4. What is the legitimacy for the processing of your data?

If you exercise your rights by a voluntary representative expressly designated, you must provide the document or electronic instrument proving the representation.

In the event that the owner of the data is a minor or incapacitated, the rights will be exercised by his or her duly accredited legal representative.

11. Data Protection Policy applicable to citizens of Brazil

The LGPD (Lei Geral de Proteção de Dados) is Brazil's federal data protection law that regulates all types of personal data processing in the country. It was passed in August 2018 and came into force in August 2020. The LGPD grants individuals within Brazil nine enforceable rights over their own personal data.

They can be found in Article 18 and grant individuals rights to:

  1. Confirmation of the existence of the processing of your data.
  2. Access to your data.
  3. Correct incomplete, inaccurate or outdated information.
  4. Anonymize, block or delete unnecessary or excessive data that is not being processed in accordance with the LGPD.
  5. Make your data portable, i.e., it can be provided to another service or processor upon request.
  6. Have your data deleted.
  7. Information about public or private entities with which the controller has shared data.
  8. Information about the possibility to refuse consent and the consequences.
  9. To revoke consent.

On the other hand, it establishes ten legal bases to be able to process personal data, we mark in bold those that correspond to the data processing carried out by Passporter and which are those described in the previous sections of this document:

  1. The consent of the data subject.
  2. For compliance with the controller's legal or regulatory obligation. for the execution of public policies provided for in laws or regulations, or based on contracts, agreements or similar instruments.
  3. For the performance of studies carried out by research entities that guarantee, whenever possible, the anonymization of personal data.
  4. For the performance of a contract or preliminary proceedings related to the performance of a contract to which the data subject is a party.
  5. For the exercise of rights in judicial, administrative or arbitration proceedings (when it concerns the parties).
