Guatemala Giveaway Rules

These Terms and Conditions govern participation in the promotion “Guatemala Trip Giveaway” (hereinafter, the “Promotion”), organized by PASSPORTER TECHNOLOGIES, S.L. (hereinafter, “PASSPORTER”), VAT number B-98846298, with registered address at C/Carrer de Ramón Gordillo, 5, El Pla del Real, 46010 València, Valencia  Spain, and contact email: info@passporterapp.com. Participation in the Promotion implies full and unconditional acceptance of these Terms and Conditions.

1. Organizer

The Promotion is organized by PASSPORTER TECHNOLOGIES, S.L. This Promotion is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc. Participants release Instagram from any responsibility related to the Promotion.

2. Eligibility

Participation is free and voluntary.

Participants must:
- Be at least eighteen (18) years old at the time of participation.
- Have legal residence in a country where participation in this type of promotion is permitted. (Europe)
- Own a real, public, and active Instagram account.
- Participate personally and under their own identity.

The following persons are excluded:

‍
- Employees of PASSPORTER.
- Employees or collaborators of companies directly involved in the Promotion.
- Immediate family members of the above.

‍
PASSPORTER reserves the right to verify eligibility at any time.

‍

3. Participation Mechanics

To participate, users must:

‍
1. Follow @passporterapp and @eddy_papeoo on Instagram.
2. Like the official giveaway post.
3. Comment on the post tagging at least one (1) friend.

Each valid comment counts as one participation provided it complies with Instagram rules and does not constitute spam.

Bonus Entry

Participants may obtain an additional participation by:

‍
- Sharing the giveaway reel in their Instagram Stories and mentioning @passporterapp

- Registering in Passporter
‍

Private accounts must ensure the Story mention is visible to PASSPORTER at the time of verification. Automated participation systems, bots, fake accounts, or coordinated participation groups are strictly prohibited.

4. Promotion Period

The Promotion will run from the publication date of the giveaway post until the deadline specified in the official Instagram post at 23:59 CET.

PASSPORTER reserves the right to extend, modify, suspend, or cancel the Promotion due to force majeure, technical issues, fraud detection, or circumstances beyond its control.

5. Prize

One (1) winner will receive:
A trip to Guatemala for two (2) people with a maximum total value of €2,200.

The trip will be organized in coordination between PASSPORTER and the winner.
‍

The prize may include, depending on availability:

‍
- Flights
- Accommodation
- Selected travel experiences or activities

‍

Prize Conditions

‍
- The maximum total value of the prize is €2,200.
- If the total travel cost exceeds this amount, the winner must pay the difference.
- Any unused portion of the budget will not be refunded or exchanged.
- The prize is personal, non-transferable, and cannot be exchanged for cash.
- PASSPORTER reserves the right to modify travel components due to availability, operational reasons, or force majeure while maintaining equivalent value whenever possible.

6. Expenses Not Included

Unless expressly confirmed by PASSPORTER, the prize does not include:
‍
- Visas or entry permits.
- Travel or health insurance.
- Vaccinations or medical requirements.
- Personal expenses.
- Meals not included in booked services.
- Optional excursions or upgrades.
- Airport transfers not specified.
- Taxes or fees imposed by authorities after booking.

7. Travel Requirements and Responsibility

The winner and their companion are solely responsible for:

‍
- Holding valid passports and required travel documentation.
- Meeting immigration and entry requirements of Guatemala.
- Obtaining visas if required.
- Complying with health regulations or vaccination requirements.

‍
PASSPORTER shall not be responsible if the winner or companion cannot travel due to documentation issues, legal restrictions, or personal circumstances.
In such cases, the prize may be forfeited.

8. Winner Selection

The winner will be selected randomly among eligible participants using a certified random selection system such as Easypromos or equivalent software.

PASSPORTER may randomly draw alternate winner(s), if necessary.

‍

9. Winner Notification

The winner will be contacted exclusively via Instagram Direct Message from @passporterapp within seven (7) days after the Promotion ends.
The winner must respond within forty-eight (48) hours confirming acceptance.
‍

If the winner:
- Does not respond,
- Rejects the prize,
- Cannot travel,
- Or fails eligibility verification,

‍
PASSPORTER may select an alternate winner.

10. Travel Organization

Travel dates must be agreed upon with PASSPORTER and are subject to availability.
PASSPORTER does not guarantee availability during:

‍
- High season periods,
- Public holidays,
- Special events.

‍
If travel becomes impossible due to external circumstances (including but not limited to airline cancellations, political situations, natural disasters, pandemics, or safety concerns), PASSPORTER may:

‍
- Postpone the trip, or
- Offer an equivalent alternative experience or destination.

‍

IMPORTANT: PASSPORTER will never request payment information via Instagram messages.

‍

11. Limitation of Liability

PASSPORTER shall not be liable for:

‍
- Failures of Instagram or internet access.
- Loss of entries due to technical errors.
- Services provided by airlines, hotels, or third-party suppliers.
- Delays, cancellations, or incidents occurring during travel.

‍
Liability shall only apply in cases of proven intentional misconduct or gross negligence as permitted by applicable law.

12. Fraud and Disqualification

PASSPORTER reserves the right to disqualify participants who:

‍
- Use fake or multiple accounts.
- Manipulate the Promotion.
- Use automated participation systems.
- Publish offensive, illegal, or inappropriate content.

‍
PASSPORTER may cancel participations suspected of fraud without prior notice.

‍

13. Image and Promotional Rights

By accepting the prize, the winner agrees that PASSPORTER may use their name, Instagram username, and travel-related content voluntarily shared during the trip for promotional and communication purposes without additional compensation, unless prohibited by law.

14. Data Protection

Personal data collected will be processed exclusively for managing the Promotion and prize delivery, in accordance with applicable data protection regulations, including GDPR.

15. Taxes

Any taxes or fiscal obligations derived from acceptance of the prize shall be the sole responsibility of the winner, where applicable under local legislation.

16. Legal Actions

Legal recourse is excluded to the extent permitted by applicable law.

‍

17. Applicable Law and Jurisdiction

These Terms and Conditions shall be governed by Spanish law. Any disputes shall be submitted to the courts of Valencia, Spain.

18. Availability of the Terms

These Terms and Conditions will be available through PASSPORTER official channels and upon request.
